Introduction

Welcome to Stunden. These Terms of Service ("Terms") govern your use of the Stunden workforce management platform operated by SecureIT Swiss AG, a company registered in Switzerland. Its full company details are set out at the end of these Terms. By accessing or using our services, you agree to be bound by these Terms.

Service Description

Stunden provides a comprehensive workforce management platform for Swiss businesses, including:

  • Employee management with role-based access and multi-tenant support
  • Project management with time tracking and budget monitoring
  • Time tracking, shift planning, and leave management
  • Swiss-compliant payroll processing, expense management, and invoicing

User Responsibilities

As a user of our platform, you agree to:

  • Provide accurate and up-to-date information for your account
  • Maintain the security and confidentiality of your login credentials
  • Comply with all applicable Swiss employment and data protection laws
  • Use the platform only for its intended business purposes

Payment Terms

The following terms apply to all paid subscriptions:

  • Subscriptions are billed monthly. The yearly plan is billed monthly at a reduced rate and has a minimum term of 12 months, which renews automatically for a further 12 months unless cancelled at least 30 days before the end of the term
  • All prices are listed in Swiss Francs (CHF) unless stated otherwise
  • Prices are exclusive of applicable Swiss VAT (currently 8.1%)
  • Overdue payments may incur interest at 5% per annum under Swiss law (Art. 104 OR)

Intellectual Property

The following intellectual property provisions apply:

  • The Stunden platform, including all code, design, and documentation, remains the property of Stunden
  • You retain all rights to the content and data you upload to the platform
  • We will not use your business data for any purpose other than providing the service
  • Anonymized, aggregated usage data may be used to improve the platform

AI Assistant Data Handling

When you use the in-app AI assistant, your messages and the resulting tool-call arguments are processed by third-party language-model providers and stored in our application database under the following terms:

  • OpenAI processes data on US-hosted infrastructure under their standard Data Processing Agreement, including EU/CH Standard Contractual Clauses.
  • Anthropic processes data on US/EU infrastructure under their standard Data Processing Agreement.
  • Both providers delete API data after 30 days (abuse-monitoring window) and do not use it to train their models.
  • Conversation content is stored in this application's database with a default retention of 12 months.
  • Tool-call arguments derived from your messages are mirrored into the audit log for compliance retention of 10 years, as required by Swiss OR Art. 958f.
  • Owners can request erasure of an individual user's AI records at any time. Chats can be deleted at any time from the chat sidebar.

Limitation of Liability

Our liability is limited as follows under Swiss law:

  • We provide the service "as is" and do not guarantee uninterrupted availability
  • We are not liable for data loss caused by circumstances beyond our reasonable control
  • We are not responsible for third-party integrations or their data handling practices
  • Our total liability is limited to the fees paid by you in the 12 months preceding the claim

Termination

Either party may terminate the agreement under the following conditions:

  • Immediate termination for material breach that remains uncured after 30 days' written notice
  • Termination for non-payment after 14 days' written notice
  • Termination for convenience with 30 days' notice at the end of a billing period; for the yearly plan, at the end of the current 12-month term
  • Upon termination, your data will be available for export for 90 days, after which it will be permanently deleted

Governing Law

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles.

Applicable Law: Swiss law

Dispute Resolution: Any disputes shall first be attempted to be resolved through mediation. If mediation fails, disputes shall be submitted to the competent courts at the registered seat of SecureIT Swiss AG, Canton of Fribourg, Switzerland.
